Who we are
This app is run by Obsidian UG (haftungsbeschränkt), Leopoldstr. 2-8, 32051 Herford, Germany, registered at Amtsgericht Bad Oeynhausen under HRB 20982. "We" and "us" in these terms mean this company, and these terms are the agreement between you and us.
What this app is
This app pays you for sharing your spare internet connection. When you turn sharing on in the app on your computer or phone, our network sends other companies' web requests out through your connection, and pays for what your device carried. How much you earn depends on how much the network sends through your device, which we do not control and do not promise. Sharing is its own switch with its own text, and nothing is shared without your yes.
Your account
- You must be 18 or older.
- One account per person. The details you give us must be true.
- Keep your password to yourself. What happens in your account is treated as done by you.
Your devices
- Share only on a computer or phone that is yours, or that you may set up with its owner's permission.
- Share only an internet connection you may share. Some internet providers do not allow it; please check yours.
- A phone shares over Wi-Fi only, unless you allow mobile data in the app's settings. Mobile data can count against your plan.
- You can remove a device, pause it, or set its daily limit and hours at any time in the app.
Your earnings
- The network counts what each of your devices carried. We settle it once a day at the rate the app shows, in whole cents; what is worth less than a cent waits for the next day.
- A settlement starts as pending. It becomes yours, available, only when both are true: its hold is over, and the network has paid us for those days. Until then you have no claim to it.
- If a settlement is taken back, or the network does not pay us for it, the pending amount is cancelled. Your Cash out screen shows every settlement, where its money is and why.
- The Cash out screen shows the date we expect a payment to arrive; it is an estimate, not a promise.
Available money and cash-outs
- Available money is yours. You can cash it out once it reaches the smallest amount shown on the Cash out screen, in the ways offered there (today: gift cards by email).
- You need a confirmed email address to cash out. We check each person's first cash-out by hand before it goes out, and may check any other.
- The amount leaves your available balance when you ask for a cash-out. If we cannot send it, for example because of a wrong address, it comes back to your available balance.
- If a settlement is taken back after its money became available, we may take that amount from your available balance. Your balance never goes below zero.
Fraud and broken rules
We reject settlements and cash-outs, and cancel the earnings involved, when we see fraud or a broken rule, for example:
- sharing from a server, a data centre or through a VPN or proxy, instead of a home connection;
- changing the app, its counts or its traffic, or running anything that pretends to be it;
- more than one account for one person, or an account used for someone else;
- sharing a device or a connection you may not share.
A cash-out rejected for fraud is not returned to your balance. We may close an account that breaks these rules. When we do, available money that did not come from fraud or a broken rule is still paid out.
Closing your account
You can close your account at any time in Settings. Cash out first: a closed account cannot ask for a cash-out. Closing it stops every device that shares. The history of your money stays as a record, as the law asks of us.
Changes to these terms
We may change these terms for a good reason, for example a new way to share, a new law or a change in what the network pays. We tell you in the app before a change applies, and you accept the new version before your next cash-out. A change never takes away money that is already available.
Liability
We are liable without limit for intent and gross negligence, and for harm to life, body or health. For slight negligence we are liable only when we break a duty that is essential to this agreement, and then only for the damage that is typical and foreseeable for it. The German Product Liability Act is not affected.
Law
German law applies. If you use this app as a consumer, the protection the law of the country you live in gives you cannot be taken away by this choice.
